This Privacy Policy is intended to provide information on the collection, use and processing of data when you (the “User”) use the www.truckcontroller.com and www.guretruck.com websites, the Truckcontroller mobile application or any other channel that Guretruck may provide in the future (the “Websites”).

In this context, we understand personal data to be any detailed information about the personal circumstances of a specific, identifiable natural person. Personal data is processed by Guretruck within the framework of a commercial relationship with the User or when the User visits the Websites for purely informative purposes.

APPLICABLE REGULATIONS

This Privacy Policy has been drafted in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), and insofar as it does not contradict the aforementioned Regulation, by the provisions of the Spanish legislative framework on the Protection of Personal Data.

By providing us with your data, the User declares that it has read and is aware of this Privacy Policy, giving its unequivocal and express consent to the processing of its personal data in accordance with the purposes and conditions expressed herein.

Guretruck may modify this Privacy Policy in order to adapt it to new legislation, jurisprudence or the interpretation of the Spanish Data Protection Agency. The Privacy Policy may be complemented by the Legal Notice, Cookies Policy and the General Conditions that, where applicable, are included for certain products or services, if such access involves any speciality in terms of personal data protection.

DATA PROCESSING

Guretruck will collect and process the following personal data, among other things, if an account is opened with TruckController:

• Driver's first and last name
• Driver card number
• Nationality of the driver
• Driver's date of birth
• Driver's formal identification document
• Driver's tax identification number
• Position of the driver

It should be noted that this data is necessary for the registration and operation of www.truckcontroller.com.

Guretruck receives the personal data of the User and the transport company employing the driver whose data is collected and processed, and does not share this personal data with any other party except those expressly authorized and indicated by the User.

LOCATION OF THE USER IN THE BACKGROUND WHEN USING THE TRUCKCONTROLLER MOBILE APPLICATION

For the correct functioning of the Truckcontroller mobile application, it is necessary for the User to accept the dialogue box that appears when opening the application and to grant location permissions by selecting the option “always allow”. This will allow the application to locate the User's GPS position, even if the device is put on standby, or the User exits the application to use another application. In order to be able to monitor these positions while the User is in these states, background access to the location is required.

If the User does not wish to allow the Truckcontroller mobile application to have access to their position in the background, we cannot guarantee correct operation and Guretruck cannot be held responsible for the results obtained.

To deactivate the position in the background, with Android devices, the User must go to Settings > Applications > Permissions manager > Location > Deactivate location. In case of iOS devices, the User must go to Settings > App GURETRUCK > Location > Never.

WEBSITE NAVIGATION

When browsing www.truckcontroller.com, non-identifying error data may be collected in order to improve the service offered by Guretruck.

PURPOSE OF THE PROCESSING OF PERSONAL DATA

User’s personal data will be processed for the following purposes:

• To provide information related to the products and services offered by Guretruck and detailed on the Websites.
• To carry out the contracting of our services through the acceptance of the corresponding quote/order and/or the signing of a commercial contract.
• To provide the services contracted by the User, such as GPS services, management of transport and road traffic fines, and the assignment of prepaid cards.
• To send you by email and/or post news and updates about Guretruck, as well as updates on our products and services.
• To collect statistical error data to improve the Guretruck’s service.

COMMUNICATION OF PERSONAL DATA

Guretruck shall only communicate personal data to the following entities:

• To entities belonging to the Guretruck economic group.
• To those third parties, bodies and public institutions of the General State Administration, Regional and Local Administrations, including the jurisdictional bodies to which it is legally obliged to provide them.
• To those data processors authorised by the User.
• Financial institutions in the event that the User contracts the Gurecard prepaid card.

RIGHT OF REVOCATION

Users have the right to revoke, at any time, the processing of their personal data.

In the event of revocation, user’s personal data will no longer be processed, except when Guretruck has reasonable grounds for continuing to process it, grounds that override user’s interests, rights and freedoms, or when the processing is necessary to assert, exercise or defend a right in legal proceedings. The processing of personal data shall remain justified until the date of revocation.

SECURITY OF PERSONAL DATA

The processing of personal data provided shall be carried out adopting the necessary technical and organisational measures to prevent the loss, improper use, alteration and unauthorised access to the same, and the measures shall be carried out taking into account the risk analysis carried out.

USER COMMITMENT

You, as a www.truckcontroller.com User, undertake to inform Guretruck of any changes to the information provided, guaranteeing that the information provided is correct, complete, accurate and truthful.

You, as a www.truckcontroller.com User, are solely responsible for the truthfulness and accuracy of the data provided, exonerating Guretruck from any responsibility in this regard.

Furthermore, Users with access to the restricted customer area undertake to keep their passwords and identification codes secret, as well as to inform Guretruck as soon as possible in the event of loss, theft or unauthorised access. Until such notification is made, Guretruck shall be exempt from any liability that may arise from the improper use of such passwords and identification codes by unauthorised third parties.

DATA RETENTION PERIOD

Guretruck shall keep the User's personal data from the time the User give its consent until such consent is revoked or the User requests that the processing be limited. In such cases, the data shall be kept in restricted format for the legally required periods.
